1. Agreement
By using tropiplants.com or placing an order, you agree to these terms. If you do not agree with them, please do not use the site.
2. Products
We sell live plants. Living things vary — size, leaf count, and exact form differ from plant to plant and from any photograph. We describe pot size and shipped height on every product page and ship plants that match those descriptions, but no two are identical.
Time-to-fruit estimates are estimates. They assume reasonable growing conditions and are not a guarantee of when, or whether, a given plant will fruit for you.
3. Pricing and availability
Prices are in US dollars and may change without notice. Stock counts are kept current but a plant may sell out between your adding it to a cart and completing checkout. If we cannot fulfil something you paid for, we refund that line in full.
We reserve the right to correct pricing errors and to cancel and refund any order affected by one.
4. Payment
Payments are processed by Stripe. By placing an order you also accept Stripe's terms. We do not store card details. Your order is not confirmed until payment is complete.
5. Shipping
We ship to the contiguous United States (the lower 48 states plus Washington DC) only. We do not ship to Hawaii, Alaska, Puerto Rico, or internationally. Certain plants additionally cannot be shipped to certain states because of agricultural regulations; those restrictions are enforced at checkout and listed on our shipping page.
Transit times are estimates, not guarantees. We are not liable for carrier delays. We reserve the right to hold shipment during extreme weather and will notify you if we do.
6. Live arrival guarantee
Our live arrival guarantee forms part of these terms. In summary: report damage with photos within 48 hours of delivery and we replace or refund. It does not cover normal transit stress, care failures after arrival, packages left in extreme weather after successful delivery, or shipments sent at your request against a weather hold.
7. Cancellations and returns
You may cancel any order before it ships for a full refund — just email us. Because they are perishable living goods, we do not accept returns of plants that arrived in good condition.
8. Your responsibilities
You are responsible for providing an accurate shipping address, being able to receive a perishable package, and complying with any local regulations that apply to growing these plants where you live.
9. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, including lost harvests, damage to other plants, or loss of profit.
10. Intellectual property
Text, photographs, and design on this site belong to Tropiplants and may not be reproduced commercially without permission.
11. Changes
We may update these terms. The version in force for your order is the one published when you placed it.
